1. Agreement to Terms

By accessing or using ValTraq, a valet parking management platform operated by Macara Software LLC ("Company," "we," "us," or "our"), including the mobile application, admin dashboard, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

ValTraq provides a cloud-based valet parking management platform that includes vehicle check-in and tracking, payment processing, reporting, photo documentation, and related operational tools for hotels, event venues, and parking operations. The Service includes a mobile application for valet attendants, a web-based admin dashboard for property managers, and SMS notifications for guests.

3. User Accounts

To use the Service, you must create an account or be provided credentials by your property administrator. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring all information provided is accurate and current

4. Payment Processing

Payment processing is provided through Stripe, Inc. By using our payment features, you also agree to Stripe's terms of service. We do not store credit card information on our servers. All payment data is handled securely by Stripe in compliance with PCI-DSS standards.

Standard payment processing fees apply as set by Stripe. Sales tax is calculated automatically based on the property's state and applicable tax rates. Property operators are responsible for the accuracy of their tax configuration and compliance with local tax regulations.

5. SMS Messaging Program

ValTraq offers SMS notifications to valet guests as part of the Service. By providing a phone number during vehicle check-in, guests consent to receive the following transactional text messages:

  • Vehicle check-in confirmation
  • Vehicle ready for pickup notification
  • Responses to car request messages

Program Name: ValTraq Valet Notifications

Message Frequency: Typically 2-4 messages per valet visit. Message frequency varies based on the number of vehicle requests during your stay.

Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation message and no further texts will be sent.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Share your account credentials with unauthorized persons
  • Use the Service to collect data for purposes not authorized by us
  • Reverse engineer, decompile, or disassemble any portion of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Macara Software LLC and are protected by intellectual property laws. The ValTraq name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Macara Software LLC. You may not use such marks without our prior written permission.

8. Data and Content

You retain ownership of all data you submit to the Service, including ticket information, customer details, vehicle photos, and payment records. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.

We are not responsible for the accuracy of data entered by users. Property operators are responsible for ensuring the accuracy of ticket information, pricing, and customer data.

9. Limitation of Liability

To the maximum extent permitted by law, Macara Software LLC shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Vehicle damage, theft, or loss occurring at valet operations
  • Errors in payment processing or tax calculations
  • Service interruptions or downtime

The Service is a management tool. We do not operate valet parking services and are not responsible for the physical handling of vehicles, keys, or customer belongings.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Indemnification

You agree to indemnify, defend, and hold harmless Macara Software LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Fayette County, Kentucky.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
